Adoption Process

Adoption for any person or couple requires a special commitment and is not something that can be decided on a whim; some of the aspects that need addressing are those of suitability. The task becomes all the more difficult when you consider in the United States, there are federal and state adoption laws; there is a great deal of procedural law to be dealt with, both state and federal. The process might be complex but that does not mean it cannot be overcome; all that is needed however, is an understanding of what is required and expected from adoptive parents in making a successful application.

Before any other considerations are taken into account, this is a legal matter where the adult(s) become the child's legal parent(s); the child in many circumstances is an orphan. Because it is a legal process, it goes much further than simply making suitable family matches as parental rights and responsibilities are given to the adopting parents; this also means the adoptive child is granted the legal rights of a natural family member. The child becomes in effect a son or daughter to the person or couple adopting them with all the legal rights that entails, including inheritance.

The adoption process must be fair to all concerned, in particular the child, so before it is finalized, the real parents must be made known to the court; this is done, in part, to assure that it is fair and lawful, and capable of withstanding any external conflicts. Of course it is not always possible to determine the parentage of the child fully; one frequent scenario consists of a child who is a ward of court, an orphan, or where the rights of their biological parents have been terminated by the courts. There are occasions where the biological parent's rights are terminated at the same time as the adoption is finalized; this can happen when a child has been removed from a teenage single mother.

If you are planning to adopt a child, it is mandatory for you to complete a home study before the placement is done; this is a federal law which must be adhered too in all cases. A home study is done to check the living conditions that the adopted child will be offered and whether the environment would be safe. In a home study, a children's social worker will conduct a criminal background check; the medical history is also reviewed and an inspection of where the child will live.

If the home study is in the adoptive parents favor, a child will be matched to them and once this is done, they will only have to wait for the placement to happen. The application is only completed when the judge who deals with family matters has had a chance to carefully inspect all the details gathered about all the parties involved. Adoption laws are always being revised, whether those of the state you reside in or federal; before making any applications to adopt, make sure you have details of the most recent legislation.
